1. Acceptance of Terms
By accessing or using any services provided by SpokeDo ("we," "us," or "our"), including the SpokeDo website, web application, and the following mobile applications (collectively, the "Services"):
- SpokeDo — Meeting intelligence and recording
- Spoke Translator — Real-time speech transcription and translation
- Spoke Class — Language learning and classroom tools
- Spoke Right — Pronunciation practice and feedback
- Spoke Work — Workplace communication assistant
you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.
2. Description of Services
SpokeDo provides AI-powered audio transcription, translation, meeting intelligence, language learning, and communication tools. Our Services use speech recognition, natural language processing, and AI models to process audio content and provide real-time and asynchronous features including transcription, translation, speaker identification, summaries, and smart replies.
3. Account Registration
To use certain features of our Services, you must create an account. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your password and account.
- Promptly update your information if it changes.
- Accept responsibility for all activities under your account.
You may delete your account at any time through the Profile section of any SpokeDo app. Account deletion is permanent and results in removal of all associated data.
4. Credits and Payments
4.1 Credit System
Our Services use a credit-based system. Credits are consumed when you use transcription, translation, and other AI-powered features. New accounts may receive complimentary trial credits.
4.2 Purchasing Credits
Credits can be purchased through Apple In-App Purchase (iOS), or Stripe (web and Android). All prices are displayed in US dollars unless otherwise noted. Purchases are processed by the respective payment provider and are subject to their terms.
4.3 Refunds
Purchases made through Apple In-App Purchase are subject to Apple's refund policy. For purchases made through Stripe, please contact us at steven.zg@outlook.com within 14 days of purchase for refund requests. Unused credits are non-transferable and have no cash value.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law.
- Record conversations without the consent of all participants where required by law.
- Attempt to gain unauthorized access to any part of the Services.
- Interfere with or disrupt the Services or servers.
- Reverse-engineer, decompile, or disassemble any part of the Services.
- Use the Services to generate content that is harmful, abusive, or violates the rights of others.
- Resell, sublicense, or redistribute the Services or credit balances.
6. Intellectual Property
6.1 Our Property
The Services, including all software, design, text, graphics, and other content provided by SpokeDo, are owned by us and protected by intellectual property laws.
6.2 Your Content
You retain ownership of the audio recordings, transcripts, translations, and other content you create using our Services ("Your Content"). By using the Services, you grant us a limited license to process Your Content solely for the purpose of providing the Services to you. We do not use Your Content to train AI models.
7. Recording Consent
You are solely responsible for complying with all applicable laws regarding the recording of conversations. Many jurisdictions require the consent of all parties being recorded. By using our recording features, you represent that you have obtained all necessary consents.
8. AI-Generated Content
Our Services use AI to generate transcriptions, translations, summaries, smart replies, and other content. While we strive for accuracy, AI-generated content may contain errors. You should review and verify AI-generated content before relying on it for critical decisions. We are not responsible for inaccuracies in AI-generated output.
9. Service Availability
We strive to maintain continuous availability of our Services but do not guarantee uninterrupted access. We may temporarily suspend the Services for maintenance, updates, or other reasons. We will make reasonable efforts to provide advance notice of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by law, SpokeDo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of or inability to use the Services. Our total liability for any claim related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Termination
We may suspend or terminate your access to the Services at any time if you violate these Terms. Upon termination, your right to use the Services ceases immediately. You may also terminate your account at any time by deleting it from the Profile section. Any unused credits will be forfeited upon account termination.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
